Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the WAFFTI website, mobile application, booking tools, dashboards, and related services (together, the "WAFFTI Platform"). WAFFTI is a product and brand operated by WAFFTI ("we", "us", "our"). By accessing or using WAFFTI, you agree to be bound by these Terms.

2. Eligibility

You may use WAFFTI only if you:

• Are at least 18 years old and legally capable of entering a binding contract under the laws of Kenya.
• Are not located in a country subject to sanctions or embargoes.
• Have not been previously suspended or removed from WAFFTI.

If you use WAFFTI on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials secure and confidential.
• Notify us immediately of any unauthorized access.
• Be responsible for all activity under your account.

4. Bookings and Payments

When you make a booking:

• You are requesting access to a space offered by a host/partner.
• A booking is only confirmed when WAFFTI marks it as confirmed and payment is successfully processed.
• You agree to use the space only for the stated purpose, time, and number of guests.
• You agree to follow all house rules, safety requirements, and access instructions.

5. Cancellations and Refunds

Cancellation policies are set by individual hosts:

• Flexible: Free cancellation up to 24 hours before check-in.
• Moderate: Free cancellation up to 7 days before check-in.
• Strict: Free cancellation up to 30 days before check-in.

If a host cancels a booking, you will receive a full refund. WAFFTI may, at its discretion, offer credits or rebooking assistance.

6. Host Responsibilities

If you list a space on WAFFTI, you agree to:

• Provide accurate and complete information about your space.
• Maintain accurate availability and pricing.
• Honor confirmed bookings or face penalties.
• Comply with all applicable laws, including tax regulations.
• Maintain the space in a safe, clean, and as-described condition.
• Respond to guest inquiries within 24 hours.

7. Host Verification

Hosts must complete verification to receive bookings:

• Submit KRA PIN, certificate of incorporation, and director ID.
• Provide bank account or M-Pesa details for payouts.
• Verification takes 24-48 hours.
• Unverified hosts cannot receive bookings.

8. Host Payouts

Hosts receive payouts:

• After the booking is completed (marked by host).
• Via M-Pesa or bank transfer (as configured).
• WAFFTI deducts a 10% platform commission.
• Payouts are processed within 3-5 business days.

9. Prohibited Conduct

You must not:

• Use WAFFTI for any illegal, fraudulent, or unauthorized purpose.
• Interfere with the security, integrity, or performance of the platform.
• Submit false information, fake reviews, or fraudulent bookings.
• Harass, abuse, or harm other users or hosts.
• Copy, scrape, or reverse engineer the platform or its content.
• Create multiple accounts or impersonate others.

Violation may result in immediate suspension or termination.

10. Disclaimers

WAFFTI is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the platform will be uninterrupted, error-free, or secure.
• Liability for the condition, safety, or legality of any listed space.

WAFFTI is a marketplace – we do not own, operate, or control the physical spaces listed by partners.

11. Limitation of Liability

To the maximum extent permitted by law, WAFFTI will not be liable for:

• Indirect, incidental, consequential, special, punitive, or exemplary damages.
• Loss of profits, data, goodwill, or business opportunity.
• Damages arising from host cancellations, space conditions, or user actions.

Our total liability for any claim will not exceed the amount you paid to WAFFTI for the booking giving rise to the claim, or $100 USD, whichever is lower.

12. Intellectual Property

All rights in the WAFFTI name, logo, software, interface, design, content, and associated trademarks belong to WAFFTI or its licensors. You may not:

• Use WAFFTI branding, design, or content without written permission.
• Copy, modify, or distribute any part of the platform.
• Reverse engineer or attempt to extract source code.

13. Termination

We may suspend or terminate your access at any time if:

• You violate these Terms.
• You use the platform unlawfully.
• You pose a risk to users, partners, or the platform.
• We are required to do so by law.

You may delete your account at any time via your profile settings.

14. Dispute Resolution

Any dispute arising from these Terms will first be attempted to be resolved amicably through our support team. If not resolved within 30 days, the dispute will be submitted to binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

15. Governing Law

These Terms are governed by the laws of Kenya. Any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the courts of Nairobi, Kenya.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on the WAFFTI Platform and update the effective date. Your continued use of WAFFTI after the updated Terms become effective means you accept them.
